The global water crisis is being exacerbated by climate change, even in the United States. Recycled water is a feasible alternative to alleviate the water shortage, but it is constrained by humans’ perceptions. The current study examines how residents’ water scarcity awareness and climate change belief influence their willingness to use recycled water directly and indirectly. Bayesian Mindsponge Framework (BMF) analytics was employed on a dataset of 1831 residents in Albuquerque, New Mexico, an arid inland region in the US. We (...) discovered that residents’ willingness to use direct recycled potable water is positively affected by their awareness of water scarcity, but only if they believe in the impacts of climate change on the water cycle. Meanwhile, the willingness to use indirect recycled potable water is influenced by water scarcity awareness, and the belief in climate change further enhances this effect. These findings implicate that fighting climate change denialism and informing the public of the water scarcity situation in the region can contribute to the effectiveness and sustainability of long-term water conservation and climate change alleviation efforts. "Time. Perception. Imagination. Phenomenological Studies on the Question of Time by Augustine, Kant and Husserl". (rus), SPb, 2013. Summary: The monograph is devoted to the key elements of the philosophy of time which determine the necessity of historicism in the analysis of subjectivity. The main idea which defined the composition and design of this work is to trace how the Kantian definition of time as the “form of inner sense” is revealed in Husserl’s phenomenology. The original intention was to understand (...) all three components of this definition. Firstly, what is the inner form, in terms of phenomenology, what are the principles of its constitution and how one can talk about the property of formation? Secondly, what is the meaning of the term "inner" in philosophy, where the division into internal and external has always been a formality, not affecting the essence of things? And finally, what sort of “sensibility” is assumed in transcendental science, bound to become the basis of understanding the history and culture. Presumably, these three Kantian concepts constituted the original plan to analyze the nature of cognitive capabilities of the subject, claiming the gnoseological stage on which the philosophy of time is unfolded. In other words, this work deals with the historical and philosophical analysis of the phenomenological principles by which the concept of time as developed in the twentieth century emerged in the framework of phenomenology. The analyze of the structure of the subject assumes that time, perception and imagination combine in a special type of inner synthesis, which may not be relevant to certain aspects of the method but maintain the basis for a kind of anthropology of time, in continuation of the traditional “inner” contemplation. I consider the inner structure of time with the account of philosophy of St. Augustine, who in many respects not only anticipated the conclusions of phenomenology, but also in his reflections encompassed deeper layers of inner experience. The first chapter is devoted to the doctrine of St. Augustine, in which the theory of time is analyzed in conjunction with the doctrine of “inner word”, specifics of memory representations and notion of inner sense. Additionally, I consider St. Augustine’s reflections about numbers that constitute the basis of aesthetic perception of music (De Musica). Thus, the philosophy of St. Augustine already covers the whole spectrum of anthropology of time, including the question of relation between time and eternity, which remains practically unexplored in phenomenology and serves as the proof of that in interactions between philosophy and theology the tradition remains important. The second chapter of this study is devoted to analysis of the transcendental aesthetic of Kant, which includes all the methodological possibilities of considering the category of time as a formal condition for any experience, consequentially serving as a foundation for further logical development by Husserl, which includes the critical disengagement of the founder of phenomenology from Kant's transcendentalism. Particular attention is paid to the origin of the concept of inner sense, as well as possible interpretations of the function of imagination, which as a transcendental ability remains the most interesting type of synthesis. Handwritten fragments of Kant’s works are also of interest to the character of the imagery as considered in detail by Husserl. Chapter three discusses the phenomenology of inner time consciousness, represented in those important aspects, without which it is impossible to speak about the internal structure of temporal experience - the subjectivity of time, retention, "living present", and the character of synthesis. Particular attention is paid to Husserl's polemics with those representatives of psychological branch in the studies of consciousness, whose ideas greatly influenced the very motivation for creating the method. Apart from the well-known criticism of Brentano, the third chapter highlights the rarely analyzed psychological ideas that motivated the choice of Husserl’s terminology - the "Präsenzzeit” by W. Stern, the "psychological analysis" by A. Meinong, and the “fusion” (Verschmelzung) by K. Stumpf. Chapter four deals with the need to analyze the specifics of image as an element of consciousness and imagery as such, which includes a system of objectified acts. Thus is revealed the very nature of synthetic connections in the acts of consciousness, as well as the presumably imaginative character of the constitution of temporal form. (shrink)

This essay fills in some historical, conceptual, and pedagogical gaps that appear in the most visible and recent professional efforts to “revive” Philosophy as a Way of Life (PWOL). I present “American Philosophy and Self-Culture” as an advanced undergraduate seminar that broadens who counts in and what counts as philosophy by immersing us in the lives, writings, and practices of seven representative U.S.-American philosophers of self-culture, community-building, and world-changing: Benjamin Franklin (1706–1790), Frederick Douglass (1818–1895), William Ellery Channing (1780–1842), Henry David (...) Thoreau (1817–1862), Margaret Fuller (1810-1850), Henry Bugbee (1915–1999), and Gloria Anzaldúa (1942–2004). Students enter the class with preconceptions about who philosophers are, what they do, how they write, and the languages in which they write. This essay suggests that the U.S.-American Pragmatist tradition could be fruitfully reconstructed by way of a dialogue with Latin American Liberation Philosophy. More specifically, I work to establish a common ground for future comparative work by: 1) gathering and interpreting Enrique Dussel’s scattered comments on Pragmatism, 2) showing how the concept of liberation already functions in John Dewey’s Pragmatism, and 3) suggesting reasons for further developing this inter-American philosophical dialogue and debate.

Discerning the decisionmaking of Kim Jong-Un and the North Korean regime on issues of peaceful engagement and warlike actions endures as a mighty challenge for U.S. intelligence analysts and policymakers. In this report, we seek to inform analysis of Democratic People’s Republic of Korea (DPRK) leadership decisionmaking. To do so, we use three discussion papers that were written to facilitate discussion of an interagency working group. The three papers are assembled here in a single report. The first discussion paper describes (...) decisionmaking among different authoritarian regimes, including North Korea, and the opening up of those economies to outside engagement. The second paper outlines two different scenarios that might occur when conventional deterrence on the Korean Peninsula breaks down and the resulting decisions that North Korea’s leadership could face. The third paper assesses DPRK decisionmaking about nuclear weapon use. The report concludes with some observations, drawn from the issues covered in these three discussion papers, about DPRK decisionmaking and stability on the Korean Peninsula. (shrink)

In abstract algebraic logic, many systems, such as those paraconsistent logics taking inspiration from da Costa's hierarchy, are not algebraizable by even the broadest standard methodologies, as that of Blok and Pigozzi. However, these logics can be semantically characterized by means of non-deterministic algebraic structures such as Nmatrices, RNmatrices and swap structures. These structures are based on multialgebras, which generalize algebras by allowing the result of an operation to assume a non-empty set of values. This leads to an interest in (...) exploring the foundations of multialgebras applied to the study of logic systems. -/- It is well known from universal algebra that, for every signature Sigma, there exist algebras over Sigma which are absolutely free, meaning that they do not satisfy any identities or, alternatively, satisfy the universal mapping property for the class of Sigma-algebras. Furthermore, once we fix a cardinality of the generating set, they are, up to isomorphisms, unique, and equal to algebras of terms (or propositional formulas, in the context of logic). Equivalently, the forgetful functor, from the category of Sigma-algebras to Set, has a left adjoint. This result does not extend to multialgebras. Not only multialgebras satisfying the universal mapping property do not exist, but the forgetful functor U, from the category of Sigma-multialgebras to Set, does not have a left adjoint. -/- In this paper we generalize, in a natural way, algebras of terms to multialgebras of terms, whose family of submultialgebras enjoys many properties of the former. One example is that, to every pair consisting of a function, from a submultialgebra of a multialgebra of terms to another multialgebra, and a collection of choices (which selects how a homomorphism approaches indeterminacies), there corresponds a unique homomorphism, what resembles the universal mapping property. Another example is that the multialgebras of terms are generated by a set that may be viewed as a strong basis, which we call the ground of the multialgebra. Submultialgebras of multialgebras of terms are what we call weakly free multialgebras. Finally, with these definitions at hand, we offer a simple proof that multialgebras with the universal mapping property for the class of all multialgebras do not exist and that U does not have a left adjoint. The paper compares Comenius’ usage of the terms unum, verum and bonum in his metaphysical writings both with the expression of the image of the Trinity in De civitate dei by Aurelius Augustinus and with the concept of existence as three basic movements in the philosophical work of Jan Patočka. The purpose of the text is to show, despite the differences in historical periods, language and life experience, the possible similarity or connection of the vision that Augustine, Comenius and Patočka (...) mediate in their works. U članku se promatraju osnovne karakteristike razvojne dinamike hrvatskoga logičkoga nazivlja od izlazka Pacelove Logike za gimnazije, prve sustavne logike na hrvatskome jeziku, 1868. godine, pa sve do Petrovićeve Logike, također za srednja učilišta, iz 1964., koja je još uviek u uporabi. Nazivlje je u tu svrhu razvrstano u nekoliko tipičih skupina. Općenito, uočava se porast zastupljenosti latinizama (i grecizama) na štetu hrvatskih naziva. U analizi nazivlja autor se ograničuje na knjige namienjene nastavi logike bilo na srednjim učilištima, bilo na (...) sveučilištu, i to na nazivlje tradicionalne logike. Mjestimice su pridodane i napomene o nazivlju moderne (matematičke) logike. (shrink)

Studie věnuje pozornost problematice demokratizace vědy, v jejímž rámci zaujímá klíčové postavení otázka, v jaké míře a zda vůbec má mít široká veřejnost možnost zasahovat do vědní a výzkumné politiky a participovat na rozhodování v odborných záležitostech. První část studie je věnována představení dvou radikálně odlišných a vzájemně protichůdných pohledů na tuto problematiku, které byly rozpracovány v rámci poválečné filosofie vědy v dílech Michaela Polanyiho a Paula Feyerabenda a v různých podobách spolu soupeří dodnes. Tyto dva pohledy, jež nás staví (...) před volbu mezi odborností na úkor demokracie a demokracií na úkor odbornosti, jsou následně podrobeny kritickému zhodnocení a v opozici k nim je představen alternativní pohled rozvíjený v rámci vědních studií Harrym Collinsem a Robertem Evansem, jenž překračuje nutnost této volby a na základě sociologických výzkumů fenoménu odbornosti nabízí způsob, jak lze odbornost a demokratické hodnoty sloučit dohromady. Atwater v. Lago Vista is a stand-alone case in Fourth Amendment jurisprudence. Often basic Fourth Amendment jurisprudence builds off other case law. There is a clear buildup regarding the exclusionary rule from Weeks v. United States (1914) to Silverthorne Lumber Co. v. United States (1920) to the expansion of “the fruit of the poisonous tree” doctrine to Mapp v. Ohio (1961) incorporating U.S. Constitution the Fourth Amendment to the states. -/- Likewise, there are cases building up from the incorporation into (...) the states from United States v. Leon (1984) to Arizona v. Evans (1995), expanding Fourth Amendment case law and rights. The cavalcade of these cases somewhat plays a ballet of expanding and contracting the rights in certain circumstances. But the rights build off and limit each other in a cognizable method. -/- Atwater v. Lago Vista is not based on such a cavalcade of cases. It is a stand-alone case at best citing 1600s case law, norms, and rules from before the founding of the United States. Tato studie se zabývá zobrazováním alchymie v malbách, knižních ilustracích i v architektuře v období raného novověku. Na jednotlivých příkladech obrazů či ilustrací prezentuje různé aspekty alchymistova života i jeho práce. Nezabývá se symbolickou alchymickou ikonografií, ale zaměří se především na zobrazování prostředí a vybavení alchymických dílen i osobností samotných alchymistů. Soustředí se zejména na vyobrazení zařízení alchymických laboratorií, s nimiž se lze setkat jak u renesančních malířů, tak v ilustracích alchymických rukopisů a poměrně ojediněle i v české architektuře. Poskytuje (...) také pohled na vyobrazení vzniklá v souvislosti s literární kritikou alchymie. Alchymisté byli zejména v dílech předních evropských humanistů často záměrně zesměšňováni, kritizováni a označováni za blázny a zloděje. V závěru se zabývá vybranými příklady ze žánrového umění, kde byli rovněž alchymisté zobrazováni často satiricky, ale i s určitou úctou, jako vzdělaní učenci. Výtvarné umění raného novověku nám představuje různé aspekty života alchymistů a je v dnešní době jednou z možností, jak se přiblížit porozumění jejich vědeckým aktivitám. Jak však studie ukazuje, k těmto obrazovým materiálům je třeba přistupovat kriticky. (shrink)

The first beginnings of modern logic in Croatia are recognizable as early as in the middle of the 19th century in Vatroslav Bertić. At the turn of the 20th century, Albin Nagy, who was teaching in Italy, made contributions to algebraic logic and to the philosophy of logic. At that time, a distinctive author Mate Meršić stood out, also working on algebraic logic. In the Croatian academic philosophy, until the publication of Gajo Petrović's textbook (1964) and the contributions by Heda (...) Festini, a critical or indifferent attitude toward modern logic prevailed. The first comprehensive modern logic textbook in Croatian was written by mathematician Vladimir Devidé (1964), known, for example, for his axiomatizations of natural numbers and classical propositional logic. In the Croatian philosophy of the 1980s and 1990s, influential logicians are Goran Švob and mathematician Zvonimir Šikić. At the turn of the 21st century, logical investigations are being intensified and extended to various branches of the contemporary logic. (shrink)

Příspěvek se věnuje problematice antického řeckého sportu, konkrétně významu sportovních zápolení a jejich výchovné a vzdělávací roli. Pozornost autor věnuje rozboru pozic filosofů Sókrata, Platóna a Aristotela. Po nastínění kontextu tématu představuje a interpretuje základní filosofické a náboženské premisy sportovního výkonu a jeho výchovné role. Řadí mezi ně úsilí o dosažení božské přízně, nesmrtelnosti, vyššího společenského postavení, ale i ideálů kalokagathia, areté a dalších ctností. Důležitý rozměr antického sportu spatřuje rovněž v jeho formativním potenciálu směřujícímu k přípravě na duševní život. (...) Hlavní část příspěvku se věnuje přístupu k pohybovým zápolením u filosofů Sókrata, Platóna a Aristotela, kteří svými úvahami k chápání výchovné role sportu podstatně přispěli. Následně se autor zaměřuje na identifikaci dobrého sportu podle zmíněných myslitelů a na zkoumání role sportu v kontextu dobrého života, který nahlíží v aristotelském rámci jako dosahování blaženosti. Cílem textu je identifikovat a vyzdvihnout výchovný smysl sportování, poukázat na jeho filosofické konotace a možnou roli sportu v otázce vedení dobrého života. ----------- This manuscript deals with the problematics of ancient Greek sport, specifically with the significance of sporting practices and their educational role. Attention is given to a detailed analysis of the positions of the philosophers Socrates, Plato, and Aristotle. After demonstrating the context, the author presents and interprets fundamental philosophical and religious premises of the athletic performance and its educational role. Among the identified features are the effort of acquiring divine favour, immortality, higher social status, but also the ideals of kalokagathia, areté, and other virtues. Important dimension of ancient Greek sport is also found in its formative potential which aims at the preparation for intellectual life. The main part of the article is focused on the approaches of the philosophers Socrates, Plato, and Aristotle towards the sporting practices. These thinkers made an important contribution to the understanding of the educational role of sport. Then, the author identifies a good sport according to these thinkers and examines the role of such sport in the context of a good life, which is considered in the Aristotelian perspective as achieving beatitude (eudaimonia). The aim of this article is to identify and highlight an educational purpose of sport, underlines its philosophical connotations, and demonstrate its possible role in the context of a good life. Platónovy pokusy o určení dobra lze nalézt v celém jeho díle. Zahrnují jak relativně „univoční“ koncepci dobra ve smyslu sókratovského intelektualismu, tak pluralističtější koncepci obsaženou v politickém projektu Zákonů. Podle vývojové interpretace Platónových dialogů to naznačuje posun v autorově myšlení způsobený poznáním obtížnosti problému. Byl to přitom údajně teprve Aristotelés, kdo vyřešil Platónův problém dobra pomocí pojmu analogie. Proti této interpretaci článek zdůrazňuje, že aristotelské pojetí analogie je hluboce zakořeněno v Platónově vlastním potýkání se s rozdílem mezi morálním a politickým (...) dobrem. Byla to především Platónovo pochopení specifické hodnoty politické plurality, které stojí v základě akademického rozlišení mezi analogia a pros hen. (shrink)

Text se zaměřuje na přijetí a vnímání darwinismu v českých zemích v 19. století, kdy bylo šíření a interpretace Darwinova učení paradoxně spjato s dvěma profesory estetiky z Karlo-Ferdinandovy univerzity v Praze, Josefem Durdíkem a Otakarem Hostinským. Ačkoliv poněkud zjednodušovali teorii přírodního výběru, Darwinovu teorii chápali jako příchod nového paradigmatu. Tento text představuje a srovnává interpretaci darwinismu u obou estetiků, zejména jejich stanoviska k teorii přírodního výběru, možnostem aplikace této teorie v estetice a teorii umění, a také jejich vztah k (...) Darwinově výkladu estetických jevů v přírodě. Jako dodatek následuje krátké vyzdvižení Darwinova učení v textech dalších českých estetiků. (shrink)

In its recent opinion in Intel v. Sulyma, the U.S. Supreme Court clarified what qualifies as the “actual knowledge” required to trigger ERISA’s three-year statutory period. The Court’s opinion, however, left open whether establishing “actual knowledge” by a plaintiff in one case serves to time-bar otherwise timely suits that challenge subsequent breaches of the same character. This article argues that, under the continuing fiduciary duty analysis that the Court set forth in Tibble v. Edison, such suits should not be deemed (...) untimely. (shrink)

V rámci filosofie věd panuje široká shoda na tom, že druhá polovina 20. století složila „labutí píseň" pozitivismu. Milton Friedman a Paul Samuelson, dva klíčoví autoři k metodologii ekonomie v daném časovém období, přitom tento vývoj ve filosofii vědy prý nikdy nereflektovali. Pozitivistická východiska - v prvé řadě v podobě redukcioni- stického přístupu - jsou tudíž stále přítomna ve vlivných teoretických konceptech rozvinutých ekonomy hlavního proudu. Značný počet autorů však v současnosti sdílí náhled, že tyto koncepty v nezanedbatelné míře přispěly (...) k vývoji, jenž ústil ve finanční krizi, vrcholící v letech 2008 a 2009. Předkládaný článek se proto táže, zda to byla právě krize - v níž mnozí spatřují empirické zamítnutí řady pozitivistických konceptů - která napsala „labutí píseň" pozitivismu v ekonomii hlavního proudu. Článek se věnuje srovnání podoby a vývoje sporu o vivisekce v Anglii a českých zemích, s důrazem na propojení protivivisekčního a ženského hnutí. První část textu na pozadí rozvoje medicíny popisuje okolnosti vzniku sporu a cestu, která vedla k přijetí první legislativy regulující experimenty se zvířaty. Druhá část představuje postoj F. P. Cobbeové, která je nejvýraznější ženskou postavu v tomto sporu. Třetí část mapuje situaci v českých zemích a nabízí důvody, které vysvětlují, proč se u nás v dané době organizované (...) protivivisekční hnutí nezformovalo. Autorka tvrdí, že klíčovou roli sehrálo pozitivní vnímání vědců, které pramenilo z jejich zapojení do procesu národního obrození. V poslední části textu jsou pak představeny názory na vivisekci dvou postav českého ženského hnutí na počátku 20. století, P. Moudré a E. Vozábové. Autorka ukazuje, že v dané době argumenty, které líčily experiment v medicíně jako nepotřebnou a neužitečnou metodu bádání, již nemohly být přesvědčivé. (shrink)

The U.S. Supreme Court's majority opinion in Vacco v. Quill assumes that the principle of double effect explains the permissibility of hastening death in the context of ordinary palliative care and in extraordinary cases in which painkilling drugs have failed to relieve especially intractable suffering and terminal sedation has been adopted as a last resort. The traditional doctrine of double effect, understood as providing a prohibition on instrumental harming as opposed to incidental harming or harming asa side effect, must be (...) distinguished from other ways in which the claim that a result is notintended might be offered as part of ajustification for it. Although double effectmight appropriately be invoked as a constrainton ordinary palliative care, it is not clearthat it can be coherently extended to justifysuch practices as terminal sedation. A betterapproach would reconsider double effect'straditional prohibition on hastening death as ameans to relieve suffering in the context ofacute palliative care. (shrink)

The United Kingdom's Parliamentary Bill 'Fraud Trials (Without a Jury) 2007', failed. Nevertheless, fraud trials without a jury do take place and there is much evidence to support this. Today the UK still does not support fraud trials without a jury, even though fraud in the UK today is the highest amount of fraud globally. The longer version of this paper is submitted here since it has become urgent that UK fraud trials be examined as a matter of urgency. On (...) page 87 of this complete paper (cut down for The Criminal Lawyer in 2008) a U.S study of 46 corporate fraud trials revealed that the defendants were CEOs, President, Chairman, Senior Vice Presidents, Chief Financial Officers, but only one entity reach trial stage. After the ce Arthur Anderson LLP v. United States, 544 U.S. 696 (2005), and the Lehman Brothers SEC case and the SEC v. Bank of America Corp., 653 F. Supp. 2d 507 (S.D.N.Y. 2009, and the Report by the U.S. Financial Crisis Inquiry on the 2008 financial crash, a global financial disaster was predicted and George Osborne, UK Chancellor pleaded for leniency for HSBC Bank frauds, threatening a global meltdown. The U.S. judiciary increased its volume of Deferred Prosecution Agreements and the UK followed suit. So, in year 2022, there is global financial meltdown and the UK has the highest rate of fraud in the world with few successful convictions. This paper is very relevant today as we must stop using deferred prosecution agreements and seek more convictions and harsh jail sentences for those financial fraudsters who have created this meltdown. -/- *When this paper was written, UK fraud was estimated at £40 million and some experts suspected twice that amount. Text představuje aktivní role-playing jako výzkumnou experimentální metodu v sociálních vědách. Zasazuje role-playing do rámce simulačních výzkumných metod, rozkrývá jeho epistemo- logii a dosavadní metodologická uchopení zejména v sociální psychologii. Hlavní linií textu je obhajoba epistemologických kvalit metody a experimentu v sociálních vědách obecně. Inspiračním zdrojem je zde na jedné straně Latourova kvalitativní sociologie asociací, tázající se po původu sociality a problematizující samotný před- mět sociálních věd, tj. sociálno. A na druhé straně přístupy naturalizující sociálně- vědné výzkumy propojením s kognitivní (...) vědou. V tomto ohledu je naším klíčovým předpokladem pro smysluplné uchopení sociální reality v její simulované podobě shodnost kognitivních mechanismů skutečného i simulovaného jednání. V pojetí textu jsou oba zdroje spojeny jejich akcentem na tematizaci sociálna jako inter-psychologického fenoménu mezi tradiční mikro a makro úrovní. Analogií s Petriho miskou text promýšlí posunutí původní metody situační sociální psycho- logie směrem k využití konstruovaných diegetických liminálních situací jako svého druhu laboratoří sociálna. Článek ukazuje pohled na utváření novověké koncepce pokroku v dílech Bernarda Le Boviera de Fontenelle. Idea pokroku byla poprvé přesně zformulována právě ve Fontenellových pracích. Podnětem pro Fontenellovy úvahy byla intelektuální debata querelle des anciens et des modernes. Tato diskuze měla rozhodnout o nadřazenosti novověku nad antikou nebo naopak. Fontenelle se debaty účastnil a závěry, k nimž došel, dovršily jeho teorii pokroku, jíž se věnoval nejen téměř ve všech pracích, ale též ve chvalořečích.

Are rights to privacy consistent with sexual equality? In a brief, but influential, article Catherine MacKinnon trenchantly laid out feminist criticisms of the right to privacy. In “Privacy v. Equality: Beyond Roe v. Wade” she linked familiar objections to the right to privacy and connected them to the fate of abortion rights in the U.S.A. (MacKinnon, 1983, 93-102). For many feminists, the Supreme Court’s decision in Roe v. Wade (1973) had suggested that, notwithstanding a dubious past, legal rights to privacy (...) might serve feminist objectives, and prove consistent with sexual equality. By arguing that Roe’s privacy justification of abortion rights was directly responsible for the weakness and vulnerability of abortion rights in America, MacKinnon took aim at feminist hopes for the right to privacy at their strongest point. Maintaining that Roe’s privacy justification of abortion is intimately, and not contingently, related to the Supreme Court’s subsequent decision in Harris v. McRae, (1980) MacKinnon concluded that privacy rights cannot be reconciled with the freedom and equality of women, and so can have no place in a democracy.1 In Harris, the Supreme Court held that the State need not provide Medicaid coverage for abortions that are necessary to preserve the health, but not the life, of a pregnant woman, effectively depriving poor women of almost all state aid for abortions.2 Moreover, the Court’s subsequent decision in Bowers v . Hardwick (1986) appeared to confirm the truth of MacKinnon’s observation – though this case concerned gay rights, rather than abortion rights, and occurred several years after MacKinnon’s condemnation of Harris. -/- This paper examines MacKinnon’s claims about the relationship of rights to privacy and equality in light of the reasoning in Harris and Bowers. When we contrast the Majority and Minority decisions in these cases, it shows, we can distinguish interpretations of the right to privacy that are consistent with sexual equality from those that are not. This is not simply because the two differ in their consequences – though they do - but because the former, unlike the latter, rely on empirical and normative assumptions that would justify sexual inequality whatever right they were used to interpret. So while I agree with MacKinnon that the Majority’s interpretation of the right to privacy in Harris is inconsistent with the equality of men and women, I show that there is no inherent inconsistency in valuing both privacy and equality, and no reason why we must chose to protect the one, rather than the other. Indeed, an examination of MacKinnon’s article, I suggest, can help us to see why rights to privacy can be part of a scheme of democratic rights, and how we might go about democratising the right to privacy in future. To avoid confusion I should emphasise that my arguments are of a philosophical, not a legal, nature. Thus, I will be ignoring the specifically legal and constitutional aspects of MacKinnon’s article, and of the Supreme Court decisions, in order to bring their philosophical significance into focus. -/- . Edmund Husserl obdržel v roce 1927 nabídku od Jamese Louise Garvina, britského editora Encyclopædia Britannica, ať napíše pro novou, tehdy čtrnáctou edici článek „Fenomenologie“. Garvin stanovil rozsah článku na 4000 slov a termín vydání na září roku 1929. Husserl pracoval na článku v časovém rozmezí mezi zářím a prosincem roku 1927, během kterého vyhotovil celkem čtyři verze. Husserl požádal o spolupráci na prvních třech verzích svého žáka Martina Heideggera, který toho času zastával profesorský stolec na univerzitě v Marburku. Heidegger strávil (...) v říjnu 1927 u Husserla několik dní, během kterých intenzivně pracovali na řečeném článku. Nicméně jejich spolupráce vedla ke vzájemnému profesnímu odcizení, protože práce na formulování článku dala vytanout nepřekonatelným obsahovým diferencím mezi oběma filosofy. Na základě Heideggerových nepřijatelných návrhů a připomínek Husserl nakonec sepsal finální, čtvrtou verzi článku již sám. Tuto poslední verzi čítající 7000 slov pak Husserl předal oxfordskému učenci Christopheru V. Salmonovi, který ji měl zkrátit a přeložit do angličtiny. Salmon sice v únoru roku 1928 opravdu dodal do redakce EB text čítající 3844 slov bez bibliografie, ovšem nejednalo se vpravdě o překlad, nýbrž dost svévolnou parafrázi. Tato podoba Husserlova článku se pak objevovala ve čtrnácté edici EB, jež se vydávala až do roku 1974, jen do roku 1956, kdy byla nahrazena článkem napsaným Johnem N. Findlayem. Původní podoba Husserlova článku byla poprvé zveřejněna až roku 1962 v rámci jeho sebraných spisů známých pod označením Husserliana, podle jejichž IX. svazku jsme vyhotovili předložený překlad z německého jazyka. Podle této edice rovněž uvádíme paginaci, která je uvedena v hranatých závorkách, přičemž stránkový přechod indikuje v textu umístěná značka |.U příležitosti 80. výročí Husserlova skonu, který připadl na rok 2018, bylo naším záměrem připomenout přínos a odkaz tohoto našeho krajana tím, že napravíme absenci překladu jeho patrně nejvíce instruktivního, přehledného a programového textu, který byť ve zkomolené podobě anglického „překladu“, po dlouhou dobu seznamoval učenou veřejnost s tím, co je to fenomenologie. ● Un emplazamiento cualquiera (v. gr. sol en Tauro; Marte en Capricornio; Mercurio en la tercera casa) es necesariamente común a decenas de miles de personas. Saturno hospedado en la novena casa, por ejemplo, no se comportará de la misma manera o no producirá los mismos efectos en las veinte o cien cartas en que allí lo encontremos, sino en concordancia con el resto de la composición astrográfica (como hospedarnos en el mismo hotel en diferentes épocas o diferentes personas haber (...) contraído la misma enfermedad; nuestra estadía será diferente cada vez, según la época, y no todos los enfermos presentarán los mismos síntomas, según su metabolismo; por no mencionar que cada astrografía, como cada código o secuencia genética, es irrepetible). Ciertamente, “ningún planeta puede, por sí solo, producir lo que solamente la acción mancomunada o conjunta de todos puede” (BUSTAMANTE, 2023, revista SPICA, págs. 93-111). He aquí la naturaleza o condición sinérgica del ejercicio interpretativo (i.e., el todo es poco más que la suma de todas sus partes). ● El componente fundamental de la expresión matemática del ejercicio interpretativo lo constituye la triangulación astrológica, denominación funcional de lo que conocemos como síntesis (WEISS, 1946; LEO, 1983; HAND, 1981). ● Con el fin de demostrar su utilidad, así como la conveniencia de su expresión matemática, hemos escogido dos individuos (JEFFREY DAHMER, STEVEN SPIELBERG) cuyas astrografías no explican, según la comunidad, sus vidas. Abstract: In Vacco v. Quill, 521 U.S. 793 (1997), the Supreme Court for the first time in American case law explicitly applied the principle of double effect to reject an equal protection claim to physician-assisted suicide. Double effect, traced historically to Thomas Aquinas, proposes that under certain circumstances it is permissible unintentionally to cause foreseen evil effects that would not be permissible to cause intentionally. The court rejected the constitutional claim on the basis of a distinction marked out by the (...) principle, i.e., between directly intending the death of a terminally ill patient as opposed to merely foreseeing that death as a consequence of medical treatment. The Court held that the distinction comports with fundamental legal principles of causation and intent. Id. at 802. -/- Critics allege that the principle itself is intrinsically flawed and that, in any event, its employment in Vacco is without legal precedent. I argue in response to contemporary objections that double effect is a valid principle of ethical reflection (Part II); claims to the contrary notwithstanding, double effect analysis is a pervasive, albeit generally unacknowledged principle employed regularly in American case law (Part III); and drawing on the preceding two sections, Vacco's application of the principle of double effect is appropriate (Part IV). -/- My conclusion is that [o]peration of some form of the principle, by whatever name, is inevitable. In an imperfect world where duties and interests collide, the possibility of choices of action foreseen to have both good and evil consequences cannot be avoided. In rare circumstances, ethics and the law require that a person refrain from acting altogether. After stating "I am gay" Navy Lieutenant Paul G. Thomasson was honorably discharged from the military. In Thomasson v. Perry (1996), the United States Court of Appeals for the Fourth District affirmed Thomasson's discharge. Thomasson is now considered the leading case evaluating the U.S. military's "don't ask, don't tell" policy. In this paper, I show that the court's analysis of the Department of Defense policy rests of two unarticulated and undefended assumptions about sexuality. The first is that an act of (...) sex is essentially defined in terms of the sexual orientation of the persons engaging in that act. The second is that whether or not a person is an open homosexual determines the essential nature of the homosexual acts of others. I conclude that both assumptions are untenable, therefore the "don't ask, don't tell" policy is indefensible. (shrink)

The project of “public reason” claims to offer an epistemological resolution to the civic dilemma created by the clash of incompatible options for the rational exercise of freedom adopted by citizens in a diverse community. The present Article proposes, via consideration of a contrast between two classical accounts of dialectical reasoning, that the employment of “public reason,” in substantive due process analysis, is unworkable in theory and contrary to more reflective Supreme Court precedent. Although logical commonalities might be available to (...) pick out from the multitude of particularized accounts of what constitutes “civic order,” no “public reason” so derived could adequately capture - and thus be able to secure in a practical sense - any single determinate civic order, much less one that would be consistent with all citizens' conceptions of public order. Part I of this Article raises a number of issues for consideration relating to the epistemology of law and focuses especially on the concept of public reason and its critique. Part II addresses alternative approaches to legal reasoning suggested by classical accounts of practical reasoning and virtue theory and considers the operation of such legal analysis outside the area of substantive due process; Part III analyzes post-Lawrence case law confirming the dilemma created by the Supreme Court's ambiguous approaches to substantive due process and concludes that only one interpretation - that articulated fully in Washington v. Gender-based forms of administrative violence, such as reproductive violence, are the result of systems designed to enact population-level harms through the production and forcible imposition of colonial systems of gender. Settler statecraft has long relied on the strategic promotion of sexual and reproductive violence. Patterns of reproductive violence adapt and change to align with the enduring goals and evolving needs of settler colonial occupation, dispossession, and containment. The U.S. Supreme Court’s recent decision to end the constitutional right to abortion in (...) Dobbs v Jackson is but one instance of this larger pattern. We analyze reproductive and obstetric violence and the structural trauma they produce through the lenses of i) historical continuity and ii) the global architectures of neoliberal settler capitalism in order to connect reproductive rights rollbacks in the U.S. with the expansion of reproductive violence across a world connected by colonial globalization. In order to graduate, Florida's high school students by law must learn that Communism is evil, dangerous, and fallacious. All students must learn that the U.S. produces the highest standard of living and more freedom than any other economic system on earth. State universities in Florida are creating a curriculum to implement the Americanism versus Communism Act of 1961 and the Free Enterprise and Consumer Education Act of 1975. ;The Florida Department of Education says that ideology, noncritical thinking, is superior (...) to critical thinking and that the superiority of the U.S. political economy and the dignity of the individual rest in part on peoples' being able to express themselves freely. ;Florida's A.V.C. and F.E.C.E.A. proponents have a special way of convincing audiences that they will develop loyalty while at the same time imposing a set of ideas not open to question. ;This work argues that, intentionally or not, Florida's legislature and Department of Education have set up an official ideology and the mechanism to purvey it. This ideological approach defeats the aim of comparing systems objectively. While the stated aim is to promote critical thinking, the D.O.E.'s special philosophy underscoring words like "democracy" results in indoctrinating students with a questionable description of the U.S. system. Ebensowenig ist daher die besondere menschliche Art, Haus- und Staatswesen zu bilden, ohne seine zoologischen Besonderheiten vorstellbar. Die menschliche Fähigkeit, sich mitteilen zu können, weist so in seine spezifische Art des Mitseins und eröffnet dadurch das, was er mitzuteilen vermag, z.B. Recht und Unrecht. Im (...) Unterschied zur Interpretation bei Thomas, der in der Art des Mitteilbaren das spezifische Mitsein des Menschen gegründet sieht, deutet sich dergestalt umgekehrt das Mitsein des Menschen sowie die Art seiner Teilhabe am Dasein überhaupt als Grundzug seiner Mitteilung und des durch sie Mitteilbaren an. Tato studie se zabývá dvěma spřízněnými jevy odehrávajícími se ve vědeckém prostředí. Jedná se o fenomén frustrace ve vědecké praxi a s ním spojenou touhu po rozpoznání vlastního výzkumu vědeckou komunitou a následně o otázku uznání od akademického společenství. Zmíněné fenomény jsou přitom úzce propojeny s ústředním tématem filosofie a sociologie vědy: kdo rozhoduje, co bude předmětem vědeckého bádání? Předkládaná studie nejprve představuje Mertonův mýtus o okamžitém rozpoznání vědeckého objevu a následně prostřednictvím exkurzu do oblasti ekonomie a na příkladech z (...) vědecké praxe poukazuje na jeho neplatnost. V závěru textu jsou společně s jejich dekonstrukcí navrhnuta možná řešení popsaných problémů. Text je také kritickým návratem ke dvěma studiím Josepha Agassiho, žáka Karla R. Poppera a tvrdošíjného zastánce kritického racionalismu, neboť právě Agassi ve svých dílech rozebírá dopady vědeckého vyloučení a neochoty naslouchat. (shrink)

In the consolidated cases Altitude Express v. Zarda, Bostock v. Clayton County, and R.G. & G.R. Harris Funeral Homes v. EEOC, the Supreme Court will decide whether or not Title VII prohibits discrimination on the basis of sexual orientation or gender identity. Although the parties disagree as to the appropriate formulation of a but-for test to determine whether or not there was a discriminatory outcome, all parties do agree to the use of such a test, which asks “whether the evidence (...) shows ‘treatment of a person in a manner which but for that person’s sex would be different.’” City of Los Angeles, Dep’t. of Water and Power v. Manhart, 435 U.S. 702, 711 (1978). However, but-for tests confuse more than they clarify the inquiry; a discriminatory outcome cannot be explained by appeal to just a discrete characteristic of a particular person. Individuals are not discriminated against because of these characteristics per se. Rather, they are discriminated against because of the social meanings and expectations that attach to these characteristics. Beyoncé and Taylor Swift illustrate the difference between individual-level causation and social explanation in two separate songs, “If I Were a Boy” and “The Man.” The explanation for why the counterfactual ‘male’ Beyoncé and Swift are evaluated differently than their current ‘female’ versions does not lie in individual-level features considered apart from the social world, but in social-level roles and expectations associated with those features. For this reason, a social explanation test—one that asks whether the social meanings of sex characteristics, rather than the characteristics per se, explain the outcome in question—is more suitable for determining whether or not Title VII has been violated. Unjustifiable assumptions about sex and gender roles, the untamable potency of maleness, and gynophobic notions about women's bodies inform and influence a broad range of policy-making institutions in this society. In December 2004, the U.S. Court of Appeals for the Sixth Circuit continued this ignoble cultural pastime when they decided Everson v. Michigan Department of Corrections. In this decision, the Everson Court accepted the Michigan Department of Correction's claim that “the very manhood” of male prison guards both threatens the safety (...) of female inmates and violates the women's “special sense of privacy in their genitals” and declared that sex-specific employment policies for prison guards is not impermissibly discriminatory. I believe that the Court's decision relies on unacceptable stereotypes about sex, gender and sexuality and it significantly undermines Title VII's power to end discriminatory employment practices. Sentencing outcomes turn on moral and evaluative determinations. For example, a finding of “irreparable corruption” is generally a precondition for juvenile life without parole. A finding that the “aggravating factors outweigh the mitigating factors” determines whether a defendant receives the death penalty. Should such moral determinations that expose defendants to extraordinary penalties be subject to a standard of proof? A broad range of federal and state courts have purported to decide this issue “in the abstract and without reference to our (...) sentencing case law,” as the Supreme Court recently put it. Kansas v. Carr, 577 U.S. 108, 119 (2016). According to these courts, “it would mean nothing” to ask whether the defendant “deserves mercy beyond a reasonable doubt” or “more-likely-than-not deserves it” because moral questions are not “factual.” Instead, moral determinations are highly subjective “value calls” to which concepts of doubt and certainty do not intelligibly apply. -/- Implicit in these rulings is a controversial view of the nature of moral judgment. This Article traces the contours of the view and argues that it is out of step with the way the broader public thinks about morality and fails to address the issues defendants have raised. Courts should avoid wading into such controversial waters for two reasons. First, the judiciary has historically maintained neutrality on issues of significant public concern. Second, even if moral determinations are not factual, applying a standard of proof to at least some moral decisions at sentencing would change the outcome of the sentencer’s deliberations, and improve the legitimacy of the legal system. For the reasonableness of doubt depends on context; and moral questions—"are you certain the defendant deserves death?”—make salient the stakes relative to which a person should decide what to believe about ordinary empirical matters. On the resulting view, reasonable doubt in the final moral analysis is not just intelligible, but essential for correcting a bias in the structure of the bifurcated criminal trial that systematically disadvantages defendants: the tendency for de-contextualized "factual findings” in the guilt phase to control outcomes at sentencing. Cílem článku je podat kritický rozbor predikcí týkajících se budoucnosti sociálních věd, jak je formuluje Ladislav Kvasz pod záštitou svého projektu „formální epistemologie". Modelem dynamiky vztahů mezi obory na vědeckém poli nabízí Kvasz v otázce střídání paradigmat alternativu ke Kuhnově teorii vědeckých revolucí. Text zkoumá, na jakých základech je mechanismus změn u Kvasze vystavěn a co z toho plyne pro relevanci předpovědí z tohoto modelu vyvozených - především těch o sociálních vědách. K tomu slouží souběžné představení historické metody Michela Foucaulta, (...) který zdůrazňuje potřebu vyvarovat se zavádění falešných kontinuit ve zkoumání trajektorií vědeckých oborů, u kterých dochází ke zlomům v jejich epistemické struktuře. Zvláštní zřetel je kladen na souvislost predikcí s možnostmi odlišit epistemologicky a sociologicky uchopitelné prvky spojené s chodem vědy. Jako klíčový moment se tedy ukáže možnost práce se sociálně vědními obory pomocí jemných nástrojů, které Kvasz vyvinul na vědách exaktních. (shrink)

Přehledová studie sleduje a analyzuje proměny pojmu sociální inovace. Na základě silné společenské poptávky se z původně dílčí, teoreticky nediskutované a nefixované kategorie stává kategorie obecná. Pokrývá širokou oblast nemateriálních inovací a zároveň se profiluje jako aktivita normativní a intencionální, zaměřená na obecně uznávané sociální cíle. Co do ideově-hodnotových orientací současných koncepcí sociálních inovací studie identifikuje kromě mainstreamu, který zůstává u otevřených hodnotových charakteristik, ještě směr emancipačně-mobilizační a sociálně-tržně odpovědný. V epistemologické rovině se teoretici sociálních inovací hlásí především k praktickému (...) experimentování, pragmatismu, teorii komplexnosti a principům transdisciplinarity. (shrink)

Lawrence Nelson (2018) criticizes conscientious objection (CO) to abortion statutes as far as they permit health care providers to escape criminal liability for what would otherwise be the legally wrongful taking of a pregnant woman’s life by refusing treatment (i.e. abortion). His key argument refers to the U.S. Supreme Court judgment (Roe v. Wade 1973) that does not treat the unborn as constitutional persons under the Fourteenth Amendment. Therefore, Nelson claims that within the U.S. legal system any vital interests of (...) pregnant women must always take precedence over fetuses’ interests. While agreeing with the main thesis of the article, we believe that the author’s argument neither vindicates his claim, nor explains why those who believe that fetuses are equally protectable human beings do not have the right to refuse to perform an abortion in lifethreatening emergency circumstances (AE). Therefore, the main aim of our commentary is to outline, by referring to our earlier works on conscientious objection in health care (Z_ uradzki 2016) and cultural exemptions (Ciszewski 2016), a better and universalizable argumentative path that would lead to the same conclusion. Tato studie je inspirována knížkou Petra Urbana Jak rozumíme druhým? Studie o sociálním rozumění a sdílení světa nejen u člověka a věnuje se současným diskuzím o povaze sociálního rozumění, zejména v případě nelinguálních tvorů. Nejvýraznější pozice zastává na jedné straně skupina srovnávacích psychologů kolem M. Tomasella, která vychází z filosofů kolektivní intencionality, na straně druhé D. Leavens a K. Bardová, kteří mají blízko k interaktivistické interpretaci problému sociálního rozumění. Bude ukázáno, že rozdíly ve výsledcích empirických výzkumů mají základ v ontologických (...) závazcích jednotlivých výzkumných programů, přičemž důležitou roli hraje vymezení se vůči problému antropologické diference. Studie se táže, je-li možné prostředky filosofi e vědy mezi soupeřícími teoriemi rozhodnout. Na závěr je uvedena možnost biosémiotické reinterpretace mimo-lidského sociálního rozumění na pozadí teorie umweltu. (shrink)

RESUMO A inseminação artificial (IA) é a biotecnologia mais empregada com vantagens superiores em relação a utilização da monta natural, cuja eficácia se dá na larga escala de reprodução entre os bovinos. Associando essa biotécnica com hormônios pode-se estabelecer manipulações do sistema reprodutivo da fêmea, levando a manejos de inúmeras cabeças de gado para inseminar a um tempo fixo. Portanto, foram realizados 5 protocolos de IATF, tendo 2 categorias de animais: nulíparas e multíparas. No protocolo 1 foram submetidas 81 multíparas, (...) resultando em 47 animais prenhes; No protocolo 2 foram protocoladas 103 animais multíparas, no qual resultou em 51 prenhes; já o protocolo 5 foram submetidas 77 animais multíparas, no qual resultou em 36 animais prenhes. Cada serviço realizado foi matematicamente calculado, sendo o ponto de partida o escore corporal, bem estar animal e a técnica bem exercida. Desta forma obteve bons resultados na (IATF) , no qual destaca-se o percentual : o protocolo 1 obteve 58,02%, o protocolo 2 obteve 49,51% na taxa de prenhez, No protocolo 3 obteve 55,67% na taxa de prenhez, o protocolo 4 obteve 53,33% de prenhes, já o protocolo 5 resultou em 46,75% de prenhez. O uso das biotecnologias da reprodução, realizadas em bovinos de corte, obteve resultado dentro do descrito pela literatura consultada. A boa taxa de prenhes apresentada na IATF deveu-se ao bom controle hormonal do ciclo estral e da qualidade do sêmen utilizado. A taxa de prenhez dos animais que foram submetidos à monta natural foi baixa pelo fato de que os reprodutores não conseguiram cobrir todas as fêmeas. ABSTRACT The artificial insemination (AI) is the most used biotechnology with superior advantages in relation to the use of natural mounting, whose effectiveness is given in the large scale of reproduction among cattle. Associating this biotechnique with hormones it is possible to establish manipulations of the reproductive system of the female, leading to managements of numerous heads of cattle to inseminate at a fixed time. Therefore, 5 IATF protocols were performed, having 2 categories of animals: nulliparous and multiparous. In protocol 1, 81 multiparous animals were submitted, resulting in 47 pregnant animals; in protocol 2, 103 multiparous animals were submitted, resulting in 51 pregnancies; and in protocol 5, 77 multiparous animals were submitted, resulting in 36 pregnant animals. Each service performed was mathematically calculated, with the starting point being the body score, animal welfare and the well exercised technique. Thus obtained good results in the (IATF), which highlights the percentage: protocol 1 obtained 58.02%, protocol 2 obtained 49.51% in pregnancy rate, in protocol 3 obtained 55.67% in pregnancy rate, protocol 4 obtained 53.33% pregnant, and protocol 5 resulted in 46.75% pregnant. The use of the reproduction biotechnologies, performed in beef cattle, obtained results within the described by the consulted literature. The good pregnancy rate presented in the IATF was due to the good hormonal control of the estrous cycle and the quality of the semen used. The pregnancy rate of animals that were subjected to natural mating was low due to the fact that the sires could not cover all the females. Keywords: Hormones. Cattle Pregnancy Rate. Wie an Politik I 2 in Verbindung mit anderen Passagen aus dem Corpus Aristotelicum, v.a. aus seinen zoologischen Schriften, gezeigt werden kann, ist die besondere Fähigkeit des Menschen, sich mitzuteilen, nicht ohne seine spezifische Zoologie denkbar. Ebensowenig ist daher die besondere menschliche Art, Haus- und Staatswesen zu bilden, ohne seine zoologischen Besonderheiten vorstellbar. Die menschliche Fähigkeit, sich mitteilen zu können, weist so in seine spezifische Art des Mitseins und eröffnet dadurch das, was er mitzuteilen vermag, z.B. Recht und Unrecht. Im (...) Unterschied zur Interpretation bei Thomas, der in der Art des Mitteilbaren das spezifische Mitsein des Menschen gegründet sieht, deutet sich dergestalt umgekehrt das Mitsein des Menschen sowie die Art seiner Teilhabe am Dasein überhaupt als Grundzug seiner Mitteilung und des durch sie Mitteilbaren an.
